Terms of Service

These Terms of Service ("Terms") govern your access to and use of apples.live and related services (the "Service") provided by Apples AI ("we", "us", "our"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.

2. Your Account

You are responsible for keeping your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized access by emailing nikita@apples.live.

We may suspend or terminate accounts that violate these Terms or applicable law.

3. Your Content

You retain ownership of content you create in your workspace (notes, custom tabs, folders, files, messages). By using the Service, you grant us a limited license to host, store, process, and display your content solely for the purpose of providing the Service to you.

You are responsible for the content you create. You agree not to upload content that:

• Violates applicable law
• Infringes third-party intellectual property or privacy rights
• Contains malware, exploits, or illegal material
• Is intended to harass, defame, or harm others

4. AI-Generated Content

The Service includes AI agents that generate content (text, code, documents) based on your prompts. You acknowledge:

• AI-generated content may be inaccurate, incomplete, or inappropriate
• You are responsible for reviewing AI-generated content before relying on it for decisions, especially in legal, financial, medical, or safety-critical contexts
• We do not warrant the accuracy or fitness of AI-generated content for any purpose

5. Third-Party Services

The Service integrates with third-party providers (Google, Stripe, Twilio, etc.) at your direction. Your use of those services is governed by their own terms and policies. We are not responsible for the availability, content, or practices of third parties.

When you connect a third-party service via OAuth, you authorize us to access only the scopes you explicitly approve.

6. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code from the Service
• Use the Service to develop a competing product
• Resell, sublicense, or commercially redistribute the Service without our written permission
• Use automated tools (scrapers, bots) to access the Service except as explicitly permitted
• Interfere with the integrity or performance of the Service
• Use the Service for spam, phishing, or fraud

7. Fees and Payment

Paid plans, if any, will be described at the point of purchase. By providing payment information, you authorize us to charge the applicable fees. Fees are non-refundable except as required by law or stated otherwise at purchase.

Payment processing is handled by Stripe. We do not store full credit card numbers.

8. Termination

You may close your account at any time by emailing nikita@apples.live. We may suspend or terminate your access for violation of these Terms, non-payment, prolonged inactivity, or for any reason with reasonable notice.

Upon termination, your right to access the Service ends. Sections 3 (content licenses), 4 (AI-generated content), 9 (disclaimers), 10 (liability), and 11 (dispute resolution) survive termination.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI-generated content will be accurate or suitable for any purpose.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL APPLES AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD 100).

11. Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to personal jurisdiction there.

12. Changes to These Terms

We may modify these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service. Continued use of the Service after changes take effect constitutes acceptance.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Apples AI regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect.
